Mike Engelhart, J.D. is an attorney licensed to practice law by the Supreme Court of Texas. He is a named partner in the Houston based law firm of Engelhart & Greenwood, L.L.P. together with his partner, Kelly A. Greenwood. He received his law degree from the University of Houston Law Center in 1995, where he was an associate editor of the Houston Law Review, and received the Lillian Kaiser Lewis Scholarship. He received a bachelor of arts degree in Political Science and Spanish from the University of Michigan in 1992 where he was a member of Tau Kappa Epsilon Fraternity. He is also currently the Democratic Nominee for Judge of the 151st Civil District Court of Harris County, Texas in 2008.
Mr. Engelhart practices in the state and federal courts of Texas, and is a member of State Bar of Texas, the Consumer Law Section of the State Bar of Texas, and the Houston Bar Association. In addition to the state courts of Texas, Mr. Engelhart is licensed to practice in the United States District Courts for the Southern, Western, Northern and Eastern Districts of Texas, as well as in the Fifth Circuit Court of Appeals.
Mr. Engelhart is fluent in Spanish as well as English, and has helped hundreds of clients who speak only, or mostly, Spanish. During his seven years of trial practice, Mr. Engelhart has successfully resolved, through litigation or settlement, hundreds of cases involving automobile and trucking accidents, personal injury and products liability, negligence of land or business owners resulting in injury to tenants or store customers, deceptive and unfair trade practices, fraud, admiralty and maritime injuries, employment law, insurance coverage disputes and bad faith, commercial cases involving contracts and debts, and medical malpractice. While he continues to enjoy the variety of his clients' cases, Mr. Engelhart now specializes in serious personal injury cases. He has tried many cases to jury verdict as lead counsel, and another 12 as second chair, and has been lead counsel or co-counsel in numerous settlements of personal injury claims exceeding $500,000.00 each.
Mr. Engelhart also has worked extensively for his clients beyond the trial court, as lead counsel in more than twelve appeals to the state and federal court of appeals. His belief is that if a lawyer is not prepared to continue the fight for his client beyond a single trial court judge's ruling, he or she should not have accepted the case in the first place. Many of the cases Mr. Engelhart has handled on appeal are now a permanent part of Texas law, and have been reported in the Southwestern Reporter series, as well as the Restatement 2nd of Torts, and American Law Reports, 3d ed. Examples include: Hooper v. Chittaluru, 222 S.W.3d 103, 110 (Tex. App.–. Houston [14th Dist.] 2006, pet. denied) (overruling trial court's exclusion of expert testimony); Ortmann v. Ortmann, 999 S.W.2d 85 (Tex. App.Houston [14th Dist.] 1999, pet. denied) (spelling out elements of bill of review cause of action in Texas); Pifer v. Muse, 984 S.W.2d 739 (Tex. App.--Texarkana 1998, no pet.) (creating new class of good Samaritan "implied licensee", and discussed in Restatement 2nd of Torts, and American Law Reports, 3rd ed. (pamph.)); Rajan v. Shepard-Knapp, 965 S.W.2d 47 (Tex. App.Houston [1st Dist.] 1998, pet. denied) (first case in Texas discussing federal statute 28. U.S.C. 1448).
In addition to his extensive legal work, Mr. Engelhart participates in his community activities as an active member of the Brith Shalom synagogue, the Jewish Community Center and the Anti-Defamation League. His first love, of course is his family, including his wonderful wife, Eva, who is also an accomplished attorney, and his beautiful sons Joseph and Zachary.
